Marroquín,
Marroquín S.C., focuses on representation of contractors,
architect-engineers and owners in the prosecution and defense of
construction claims (We do not represent sureties). We regularly
represent our clients in complex cases involving a wide assortment of
projects, including bridges, courthouses, hospitals, industrial process
facilities, office buildings, roads, and power plants.
Our attorneys handle the full range of construction disputes, with
particular experience and capability in delay, disruption and
acceleration claims, default terminations, design changes and
deficiencies, concealed conditions, structural failures, surety claims,
and interpretation, reformation or rescission of contract terms, mistake
or fraud. We have substantial expertise in all construction damages
issues, including no damages for delay clauses, exclusion of
consequential damages and limitations on total cost claims.
We also regularly draft and negotiate construction contracts for our
clients. Our construction attorneys have excellent academic and real
world credentials, and have litigated construction cases in virtually
every forum in which construction disputes arise. We are routinely
involved in matters of defective cost or pricing data, cost accounting
standards, multiple award schedule contracts, lease disputes, audit
rights and patent and technical data rights.
We represent our clients vigorously at every stage of proceedings, from
initial claim through trial and appeal. Often, however, litigation is
not in the client's best interest, and we frequently utilize mediation
and other alternative dispute resolution mechanisms to settle cases
favorably without necessity of trial.
Some of our attorneys participate constantly as lecturers in
construction law seminars specially directed to Directors and/or General
Managers promoted by well recognized institutions such as: a) The
Guatemalan Chamber of Construction; and, b) National and foreign
Universities.
